Resident Rights Reminder for SNFs & ACFs

NYSHFA/NYSCAL is working with the DOH related to their Advisory on Residents Rights issued today. The DOH issued this Advisory as a consequence of several confirmed cases of SNFs discharging large numbers of residents to shelters both in Upstate and in NYC without proper notice or acceptance by the residents. These discharges were not the result of surge issues. Surge assessments for potential discharge of residents should follow the normal process of assessment and used only when the need is imminent. DOH is in active discussions with CMS related to the transfer and discharge regulations in light of the pandemic and will issue any CMS changes to the rule as soon as they are released. The DOH is developing a Webinar which may be presented as soon as tomorrow (Friday) to discuss the intent of the Admission and Transfer policies for SNFs and ACFs.
