Update from NYSDOH on Access to the Informal Dispute Resolution (IDR) Form

New York State has an Informal Dispute Resolution (IDR) process as required by state and federal regulations, 42 CFR 488.331.

The Informal Dispute Resolution process affords the nursing home facility one (1) opportunity to provide additional information that may result in a revision to the Statement of Deficiencies (SOD). To dispute deficiencies, the nursing home must submit an electronic version of the IDR form (in Word format) to idr@health.ny.gov. The IDR form and instructions for its completion can be found on the Health Commerce System (HCS). However, if you have difficulty locating the form, please e-mail DOH at this noted address: idr@health.ny.gov. DOH will forward you a copy of the IDR Form. 

All IDR information (including the electronic IDR form and the required number of hard copies of all supporting documentation) must be submitted within ten (10) days of receipt of the SOD and presented in a manner that is consistent with the guidelines provided in DAL: NH 12-04, issued June 29, 2012.
