This presentation will focus on emerging regulatory and enforcement trends in data security in the State of New York. The Speaker will utilize recent guidance, enforcement actions and public statements published by state and federal regulators to emphasize important data security and privacy issues applicable to assisted living and nursing home operators. Recent federal and state legal developments and enforcement actions are highly relevant to New York long term care providers and illustrate the growing importance of data security. For example, this session will review recent guidance and settlement agreements by the New York State Attorney General’s Office and the HHS Office for Civil Rights. These recent developments offer important lessons about common mistakes by providers and areas of focus in enforcement actions and investigations.  We will review the latest developments and discuss how to best address these risks and evolving expectations and, in some cases, the need to change organizational priorities.
