On October 27, the Survey and Certification Group (S&C) at the Centers for Medicare & Medicaid Services (CMS) released two memorandums, "Revised Policies Regarding the Immediate Imposition of Federal Remedies - FOR ACTION," (S&C:18-01-NH)  and "Clarification Regarding Nurse Aide Training and Competency Evaluation Program (NATCEP/CEP) Waiver and Appeal Requirements" (S&C: 18-02-NH).

CMS also released a web-based provider training on the new Long Term Care Survey Process, which goes into effect on November 28, 2017.

Click here for a summary of the two memos AHCA put together for your use.

  • Revised Policies Regarding the Immediate Imposition of Federal Remedies
CMS is seeking public comment on the immediate imposition of federal remedies memo, which has been released in draft form, by December 1, 2017. AHCA is reviewing the memo and will provide CMS with detailed comments. Please share any comments with Sara Rudow, AHCA Director of Regulatory Services, by Monday, November 13, 2017 at SRudow@ahca.org. You may also provide comments directly to CMS at dnh_triageteam@cms.hhs.gov by December 1, 2017. CMS will review public comments before issuing a final version.
  • Clarification Regarding Nurse Aide Training and Competency Evaluation Program Waiver and Appeal Requirements
Information included in the nurse aid training memo S&C: 18-02-NH is effective immediately.
  • New Long Term Care Survey Process Provider Training
CMS has posted the one-hour web-based training, "Overview of the New Long Term Care Survey Process for LTC Providers" on its Integrated Surveyor Training Website here. The training provides an overview of new regulatory reform, key changes to the survey process, CMS' rationale behind the changes to the survey process, and the basic steps in the survey process that are important to providers.
