DAL #15-06 – Transfer and Discharge Requirements for Nursing Homes

The DOH has issued the attached DAL as a reminder related to transfer and discharge requirements for SNFs.  The requirements have not changed, however, the department is concerned about trends they are seeing with relation to:

  1. Failure to issue written discharge notices and
  2. Refusal to readmit residents who are temporarily hospitalized. The DAL re-emphasizes that “hospitals are not acceptable final discharge locations.”


Questions related to transfer and discharge requirements should be referred to Mary Jane Vogel and Joanne Breden in the complaint division, 518-402-5447.  They have been very helpful in assisting providers and we encourage you to use them as a resource for questions or to work with your team to resolve difficult transfer/discharge issues.

BNE Update: E-Prescribing Resource

BNE has issued the attached resource document related to E-Prescribing.  The document addresses many of the providers’ frequently asked questions.  It also contains contact information and links to additional resources.  Please keep this document as a resource for yourself and share it with your Medical Director, Director of Nursing, Consultant Pharmacist and Staff Development Coordinator. E-Prescribing will go into effect for all prescriptions on March 27, 2016.

AHCA Meeting with CMS – Minutes

This annual presentation provides an overview of the fraud, waste, and abuse enforcement landscape and addresses current trends and hot topics.  Brian Feldman, the speaker, is a former Assistant U.S. Attorney who previously directed health care investigations out of Manhattan, and who now represents health care facilities in responding to enforcement actions by actors such as the U.S. Department of Justice and the New York Attorney General’s Medicaid Fraud Control Unit.  The presentation addresses criminal, civil, and regulatory enforcement trends, including False Claims Act trends, at both the state and federal level.

Florence's Art Brings Back Childhood Memory as we "Head Back to School"

Our September artist, Florence Teichner, 88, is a resident of Kingsway Arms Nursing Center for the past five years.  Her painting, “Kids Corner” depicts the street she lived on as a child, and the kids she grew up with.  “It’s about childhood memories in the summer,” Florence explained.

Our goal is to honor more than 85 artists like Florence who are residing in nursing homes and assisted living facilities across New York State by creating an “Art from the Heart” digital slide show.
