Universal Settlement Update

The State has reported progress regarding the advancement of numerous aspects of the Universal Settlement.  This includes contract review, analysis of submitted rate appeal and litigation exclusions, audit inclusions and review of relevant settlement documents.

DOH has approved approximately 75% of Providers’ exclusion requests.  DOH will issue a letter to Providers identifying which exclusion requests have been rejected, with information related to requests for reconsideration.

The State has indicated that 120 homes have not yet responded to the exclusion requests.  The final deadline for submission of those lists is May 13, 2015.  Failure to submit a list by that date will result in the inclusion of all rate appeals and litigation in the settlement.

Progress also has been reported in discussions with CMS, which must approve the Universal Settlement proposal.
