NYSHFA Discussions with DOH are Successful in Delaying Therapy Changes to Medicaid MDS Assessment

NYSHFA met with top DOH officials to advocate for members to have appropriate Notice of Changes to the Medicaid only assessment process before changes are implemented. We received written notice on Friday that they have agreed with our request and will apply the changes they announced in October to the current assessments beginning October 2014, and reversed their decision to implement the O0420 and RUG scoring retroactively.  According to DOH, postponement of the therapy implementation resulted in a $4M statewide cost (i.e., provider savings) in 2014.  Members are urged to verify that these therapy changes are now in place with their software vendors.  See the attached DOH letter for more details.

Capital Restructuring Financial Program

NYSHFA/NYSCAL attended a public hearing on the Capital Restructuring Financial Program held on 11/21/14.  We submitted both orally and in writing specific questions related to the availability of funding for proprietary providers, as well as requesting additional time for application submissions (currently due on 12/22/14).

OMIG: Compliance Certification Deadlines

There are two compliance certifications due for 2014 by year's end:

New York State Social Services Law Section 363-d Certification Reminder

All New York State Medicaid providers who are required to have a compliance program under New York State Social Services Law Section 363-d must certify that their compliance programs are effective each year.  The certification must be completed during the month of December.  The Social Services Law certification is an online certification that can be accessed on OMIG’s website at www.omig.ny.gov under the Compliance tab.  Look for the Certification sub-tab and look for the form under the heading “NYS Mandatory Provider Compliance Programs.”  Frequently asked questions and directions are also located there.  Additionally, when you complete the certification, you will receive a confirmation e-mail from OMIG and a confirmation receipt.  We encourage you to print a copy and keep it on file.

Federal Deficit Reduction Act of 2005 Certification Reminder

If you are a NYS Medicaid provider subject to the Federal Deficit Reduction Act of 2005 (DRA), you must provide a certification that you are meeting the DRA’s requirements.  The certification must be completed each year prior to January 1st.  The DRA certification is an online certification that can be accessed on OMIG’s website at www.omig.ny.gov under the Compliance tab.Look for the Certification sub-tab and look for the form under the heading “Federal Deficit Reduction Act.”  You will also find frequently asked questions and directions located there.  Additionally, when you complete the certification you will receive a confirmation e-mail from OMIG and a confirmation receipt.  We encourage you to print a copy and keep it on file.

Healthcare Personnel Vaccination Report Clarification

The following clarification was provided to us by DOH staff regarding our questions related to the DOH notification on the Healthcare Personnel Vaccination Report and subsequent MM issued last week:

“Facilities are required to submit the report by May 1, 2015 but it is recommended that facilities enter their data as soon as possible and then update (edit) it as needed during the influenza season (e.g. update when new employees are hired or volunteers begin working in the facility. There is only one submission that needs to be done by May 1, 2015. Essentially the report is staying open from November 2014 until May 1, 2015.

Regarding the Quality Pool:  There is only one required reporting period this year for the employee influenza vaccination information - May 1, 2015.  Reporting on-time will yield 5 points in the NH Quality Initiative.”
