Nurse Staffing Mandate Legislation

Yesterday the New York State Nurses Association (“NYSNA”) held a rally outside Greater New York Hospital Association’s (“GNYHA”) offices and criticized GNYHA for opposing nurse staffing ratio legislation. Attached, for your information, is NYSNAs press release regarding the rally and GNYHAs press release in response. NYSHFA, together with the GNYHA and several other statewide and regional associations, is a Member of the Coalition for Safe and Affordable Care, an ad hoc organization actively opposing the nurse staffing mandate legislation.

MDS 3.0 RAI Manual - October 1st Update Now Available

CMS has posted the MDS RAI Manual v.1.12 for download on their website. The revisions become effective on October 1, 2014. Sections of the manual that include changes are Chapter 1, Chapter 2, Chapter 3 (Sections A,C,E,G,H,J,K,M,N,O,X and Z), Chapter 5 and Chapter 6. Join us on October 23, 2014 for "Nursing Homes in the Crosshairs:  Significant Federal and State Enforcement Trends and Developments" audio conference from 10:00 am - 11:30 am presented by Brian M. Feldman, Esq., Harter Secrest & Emery LLP.

The U.S. Department of Justice, the New York Attorney General, and other federal and state regulators have been actively investigating and pursuing cases against nursing homes, their owners, and their employees over the past year.  This presentation will discuss the latest enforcement trends, as well as significant legal developments in this field.  Among other things, the presentation will address the risks of corporate and individual liability under the government’s False Claims Act, a statute that incentivizes actions by whistleblowers and grants the government treble damages.
