A frequent question faced by staff of skilled nursing facilities is whether a resident has the cognitive ability to make independent decisions about their care and preferences. This question of capacity should always be understood through the lens of our obligation to foster residents’ rights, dignity, and independence. As a result, the question of capacity is always a balancing act between the resident’s well being and their right to exercise free choice and have their preferences respected.

This audio conference will address different types of capacity, common situations which raise the question of capacity in a skilled nursing setting, factors which contribute to determining capacity, and related implications. Participants will gain a better appreciation of when the question of capacity should be raised, ways to establish a workable process for the determination of capacity, family involvement, and implications for care planning.
