E-Prescribing Law Goes into Effect March 27, 2015

NYSHFA had a meeting with the Board of Narcotic Enforcement (BNE) and the Board Of Pharmacy and Consultant Pharmacists on May 6, 2014 to discuss the new law that will be effective on March 27, 2014 whereby all medical orders will need to go directly to the pharmacy from the physician via e-prescribing before they can be acted upon by the pharmacy. We believe e-prescribing will greatly reduce transcription errors in medication administration, but also have noted concerns about the ability to transfer to this new system without assistance in technology and recognition of systems that work and may need to be maintained.

Attached are slides from a PowerPoint presentation from Anita Murray, R.Ph, Assistant Director, BNE that gives an overview of the law, and also attached is a summary of the questions we posed to the BNE and Board of Pharmacy at our May 6, 2014 meeting. These Q&As cover some of the discussion, but there was a focus of discussion related to interfacing e-prescribing with individual SNF EMR and MAR systems; the lack of ability for verbal and phone orders to be enacted without the physician sending in the e-prescription especially on off shifts and weekends when cross coverage is occurring; and current delays in medication administration that we are already facing in SNF when residents transfer across the continuum. 

NYSHFA staff updated the DOH Surveillance and QA division of our concerns after the May 6th meeting, gave an update at our DOH/Provider meeting last week and also reached out to the Medical Director group. Our SNF partners are wanting to work together to assist with this process.
