New Smoking Restrictions at Nursing Homes and Hospitals

Governor Cuomo recently signed legislation into law (Chapter 179 of the Laws of 2013) prohibiting smoking within 15 feet of an entrance or exit to a hospital or nursing home building or grounds. This new law, which takes effect on October 29, 2013, provides an exemption for nursing homes to permit smoking by certain individuals in designated smoking areas that are not within 30 feet of a building.

DAL Regarding Americans with Disabilities Act (ADA)

The attached DAL related to the Americans with Disabilities Act (ADA) was posted to the HCS this past week. The DAL is a reminder to all health care service providers of their obligations under the ADA. As a health care provider you are required, by one or more laws associated with the ADA, to ensure that health services are fully accessible and equally provided to individuals with disabilities. As such, an individual with a disability must have access to the same health care services that someone without a disability receives.

The NYSDOH advises all providers to evaluate their facilities’ compliance with these laws and to develop a plan to become compliant, as needed, to ensure that individuals with disabilities have full and equal access to programs and services.

The DAL provides a comprehensive outline of the steps providers can take to “ensure access to health care services” as defined by the law,  including removal of physical barriers, providing “auxiliary aids and services” and making reasonable changes to policies, practices and procedures.

CMS Region II and NYS Score Well on Reduction of Off-Label Antipsychotic Usage

CMS released results of the Nationally reported Quality Measure for Antipsychotic Medication usage for Quarter 1, 2011 through Quarter 1, 2013.  NYS has had one of the lowest rates over this entire period and, in addition, has reduced their percentage by an additional 8.27%.  NYSHFA has been an active partner of the NYS Dementia Coalition and also has provided multiple events on person centered care and alternate methods for behavior management and care planning interventions for needs based behaviors over the last several years.  See attached document for CMS regional and state by state comparisons.
