Dues Must be Paid through First Quarter to Qualify to Vote for Elected Officers at General Membership Meeting on June 25, 2013

With our Annual Convention quickly approaching (June 23-26), we want to remind all members of the importance of exercising their Voting rights at the annual Election of Officers on Tuesday, June 25, 2013.


Further requirements concerning voting privileges as contained in Article X of the By-laws are provided below:

Article X – Voting Membership – Meeting

Section 1. Every Facility Member and Provider Member of this Association in good standing shall be entitled to vote on all proper questions at any meeting, except that voting at the annual meeting shall be limited to those Facility Members and Provider Members whose dues have been paid through the first quarter of the calendar year in which the meeting occurs.

Section 2. Each Facility Member shall have the right and privilege of one (1) vote to be cast by one (1) person designated as the delegate representing that facility. Each Provider Member shall have the right and privilege of one-half (1/2) vote to be cast by one (1) person designated as the delegate representing that Provider. Each Facility Member and Provider Member must have a separate delegate representing that facility or provider, so that no delegate may represent more than one (1) facility or provider. Such person must be actively engaged in the administration or ownership of that Facility Member or Provider Member as the case may be.

MDS Case Mix Audit

NYSHFA staff have been actively engaged with the Department of Health since the fall of 2012 on developing and facilitating an MDS Audit System. As part of that process, we have been continuously attempting to facilitate the payment of what was due to facilities.

Although we are disappointed in not being further along in the process, we have continuously updated our Legal Action Committee as to the status of this activity. It has been the position of the Legal Action Committee, as a recommending body to the Executive Committee, not to take legal action at this time. The Executive Committee concurs with that decision and has directed staff to continue to participate in the facilitation process and to update membership on a regular basis. We, of course, will continue to do that.

CMS: S&C: 31-22-NH Life Safety Code Short Form Survey

In April, CMS  sent out this S&C letter which outlines a proposed method states could employ to conduct a short version life safety survey in SNF across the nation.  Each state chooses to implement or not. NYSDOH is reaching out to providers to review this document and give feedback to them within the next month. CMS would identify the SNF by state that would be eligible for this short version based on specific criteria they have developed. It looks to be a system that would reward those who have successfully completed the installation of a fully sprinklered facility, have had life safety surveys with minimal issues over time and demonstrate low risk in this area. Tell us if you agree or identify any problems with this proposal.
